By accessing or using My Theme Park Pal ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must immediately stop using the Service. Your continued use of the Service constitutes your acceptance of these Terms and any future modifications.

You must be at least 18 years old or have parental/guardian consent to use this Service. By using the Service, you represent and warrant that you meet these eligibility requirements.

My Theme Park Pal is an AI-powered web chat concierge service that provides information and recommendations for theme park visitors. The Service is an independent third-party service and is not affiliated with, endorsed by, or sponsored by The Walt Disney Company, Universal Parks & Resorts, or any other theme park operator.

What the Service Provides:

• AI-powered responses to theme park questions via browser-based chat
• Wait time information
• Dining availability and restaurant information
• Show times and entertainment schedules
• General park information, tips, and recommendations
• Access from any device with a web browser

What the Service Does NOT Provide:

• Theme park tickets or guaranteed entry to any park
• Dining reservations or booking services
• Official park communications or announcements
• Professional travel, medical, or financial advice

Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

Accurate Information

You agree to provide accurate, current, and complete information when creating an account and to update such information as necessary.

Prohibited Activities

You agree NOT to:

• Use the Service for any illegal purpose or in violation of any applicable laws
• Send spam, harassment, threats, or abusive content through the Service
• Attempt to "jailbreak," reverse engineer, or manipulate AI prompts to bypass safety filters
• Attempt to make the AI generate harmful, illegal, defamatory, or infringing content
• Scrape, crawl, or use automated tools to extract data from the Service
• Attempt to compromise, hack, or disrupt the Service's functionality or security
• Share your account access with others without authorization
• Use the Service to build a competing product or for commercial purposes without permission
• Circumvent any rate limits, access controls, or technical restrictions

We reserve the right to ban users who attempt to manipulate the AI into generating harmful content or who violate these terms.

AI Accuracy and Hallucinations

The Service utilizes artificial intelligence and machine learning technologies ("Generative AI") to provide responses. You acknowledge that Generative AI is experimental and may produce inaccurate, incomplete, offensive, or misleading information ("Hallucinations"). You agree to independently verify any critical information—including but not limited to park hours, ride availability, wait times, pricing, dining reservations, and health/safety information—with official theme park sources before relying on it.

No Professional Advice

The output provided by the AI Concierge is for informational and entertainment purposes only. It does not constitute professional travel advice, medical advice, financial advice, or legal advice. We are not liable for any decisions you make based on the AI's recommendations, including but not limited to missed reservations, travel disruptions, health issues, or financial losses.

Ownership of AI Outputs

As between you and us, to the extent permitted by law, you own the specific output generated for you by the Service based on your inputs (such as personalized itineraries or recommendations). However, you acknowledge that due to the nature of AI, similar or identical outputs may be generated for other users, and you have no exclusive rights to such common outputs.

Third-Party AI Models

Our Service utilizes third-party large language models (including but not limited to Google Gemini). We do not control these underlying models and are not responsible for their logic, training data, potential biases, or outputs. Service availability is subject to the uptime and availability of these third-party providers.

Our Content

The Service, including its design, logos, software, compilation of data, and original content, is the intellectual property of My Theme Park Pal. You may not copy, reproduce, distribute, or create derivative works from our content without express written permission.

Data Accuracy

All theme park data displayed in the Service (including wait times, schedules, dining availability, and other operational information) may differ from actual conditions at the theme parks. We do not guarantee the accuracy of any data.

User Content

If you submit content through the Service (such as feedback or reviews), you retain ownership of that content but grant us a non-exclusive, worldwide, royalty-free license to use, display, and incorporate such content to improve and promote the Service.

Trademarks

All theme park names, ride names, character names, and related trademarks mentioned in the Service are the property of their respective owners. Our use of these names is for informational purposes only and does not imply any affiliation or endorsement.

The Service may contain links to third-party websites, services, or resources (such as official theme park websites, booking platforms, or information sources) that are not owned or controlled by My Theme Park Pal.

We are not responsible for the content, privacy policies, practices, availability, or accuracy of any third-party sites or services. Your interactions with third-party services are solely between you and that third party, and you access them at your own risk.

The inclusion of any link does not imply endorsement, affiliation, or sponsorship by My Theme Park Pal.

Independence from Theme Parks

My Theme Park Pal is an independent service and is not affiliated with, endorsed by, or connected to The Walt Disney Company, Universal Parks & Resorts, SeaWorld Parks & Entertainment, or any other theme park operator. Any theme park names, ride names, and related terms are trademarks of their respective owners.

No Ticket or Entry Guarantee

Our Service is not a park ticket. Purchasing a subscription to or using My Theme Park Pal does not guarantee entry to any theme park or access to any attraction, dining location, or experience. You must obtain valid admission separately from the respective theme park operator.

Operational Changes

We are not responsible for ride closures, attraction refurbishments, park capacity limits, weather-related cancellations, special events, or changes to park operating hours. Theme park operations are subject to change without notice at the sole discretion of the park operators.

Pricing Information

Prices for food, merchandise, tickets, Lightning Lane, or other theme park products/services shown in the Service are estimates based on available data and may differ from actual prices at the point of sale. Always verify current pricing directly with the theme park or vendor.

Force Majeure

We are not liable for any failure to provide accurate information or service due to circumstances beyond our reasonable control, including but not limited to natural disasters, severe weather, pandemics, government actions, theme park closures, or technical failures of third-party systems.

"As Is" and "As Available"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

No Guarantee of Accuracy

We do not warrant or guarantee the accuracy, completeness, timeliness, or reliability of any information provided through the Service. Wait times, park hours, prices, availability, and other information may be inaccurate, outdated, or subject to change without notice.

Service Availability

We do not guarantee that the Service will be uninterrupted, secure, error-free, or available at any particular time or location. The Service may be temporarily unavailable due to maintenance, technical issues, third-party service outages, or circumstances beyond our control.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MY THEME PARK PAL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability, so the above limitations may not apply to you. In such cases, our liability will be limited to the fullest extent permitted by applicable law.

We reserve the right to terminate or suspend your access to the Service at our sole discretion, without prior notice or liability, for any reason, including but not limited to:

• Violation of these Terms of Service
• Engaging in prohibited activities
• Attempting to manipulate or abuse the AI system
• Fraudulent or illegal activity

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved informally, it shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in New Castle County, Delaware.

Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration against My Theme Park Pal.

Small Claims Court

Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.

Information We Collect

• Account Information: Email address used to identify and authenticate your account
• Message Content: Your questions and our AI responses are stored to maintain conversation context and improve service quality
• Usage Data: Timestamps, message frequency, feature usage, and interaction patterns for service improvement and analytics
• Device Information: Browser type, operating system, and general device information for compatibility and troubleshooting
• Location Data (Optional): If you enable location services for features like "Find nearest restroom," we process your GPS coordinates to provide proximity-based results. We do NOT permanently store your real-time location - it is only used transiently to answer your query. We may log that location was used (for analytics) but NOT your coordinates.

How We Use Your Information

• Provide and personalize responses to your inquiries
• Maintain conversation history for context-aware assistance
• Process your location (when you grant permission) to find nearby facilities and attractions. Your coordinates are discarded immediately after generating the response
• Improve service quality, AI response accuracy, and user experience
• Prevent abuse, fraud, and ensure service security
• Send service updates, important notifications, and account-related communications
• Generate anonymized, aggregated analytics (e.g., "Popular searches") to improve the Service

Data Sharing

We do not sell your personal information. We share data only with:

• Google: AI services (Gemini) for generating responses. Your queries are processed to provide answers.
• Supabase: Database hosting for account and message storage
• Legal Requirements: We may disclose information if required by law, court order, or government request

Data Retention

We retain conversation history for up to 90 days to provide context-aware responses and improve service quality. Account information is retained while your account is active and for up to 30 days after deletion request to allow for account recovery and comply with legal obligations.

Your Rights

Depending on your jurisdiction, you may have the right to:

• Request access to and a copy of your personal data
• Request correction of inaccurate personal data
• Request deletion of your account and associated data
• Object to or restrict certain processing of your data
• Data portability (receive your data in a structured format)
• Withdraw consent where processing is based on consent
• Revoke location permission at any time through the in-app location toggle or your browser settings. Denying location access does not affect other features
